Before we recommend the sales price for a house, we will develop a Highest Price Market Analysis (HPMA) that will help set the highest price that the house could be sold for. This analysis will show the listing price of similar houses in the area as well as the prices at which the houses actually sold. Additionally, the analysis will give us information about houses currently on the market and about houses that were on the market but never sold. Based on a well done HPMA, we are able to show seller the current market conditions. Each home is given its own sale’s Timing Analysis and a personalized marketing strategy developed specially for that home.

Next, we’ll discuss seller’s  goals and expectations. Everyone who seller has different goals that need to be factored in when calculating the listing price. Lets think about the following goals.

Listing Contract

As professional listing agents, we make sure that our clients and customers are as knowledgeable as possible about  everything involved in the listing process. Following, you will find some very useful information about the listing process and contract.

The Listing Contract
Also referred to as a listing agreement, the listing contract gives a licensed real estate professional/Realtor authorization to act on behalf of the seller. Listing contracts come in all shapes and sizes, but there are characteristics which are common to them all. Among the elements of any valid listing contract are:

Writing – All real estate contracts must be in writing.

Employment – The listing contract is a personal services contract between the seller and the Realtor/realty company. It contains all of the terms and conditions of employing and authorizing the broker to represent the seller in marketing and selling process. The Listing contract protects the seller and the Realtor from any illegal and unethical issues.

Compensation – For any contract to be valid, there has to be compensation. The listing contract will specify the amount and timing of payment to your Realtor. Typically, payment is an agreed upon percentage of the sales price, payable at closing. It is important to note that sellers obligation to pay the broker may not absolutely depend on a finalized sales transaction. For example, if the broker finds a bona-fide buyer who is willing to pay the asking price and agree to the terms, but the seller for some reason decides not to sell, the broker has done his job and is entitled to his compensation under the terms of the listing contract. The Realtor compensation is always negotiable; however, the old saying “You get what you pay for”  also applies here. The Realtor compensation covers both agents in the transaction with 50% going to the listing agent and 50% to the selling agent.

Title – All listing contracts contain the names of the  owners who are in the  title of the property. Property can’t be sold unless everyone who holds title interest in the property agrees to the sale. In North Carolina, it takes one to buy but two to sell. Meaning that if the owners  are married, both of them need to sign in order for the property to be sold.

Termination date – Sellers shouldn’t sign any listing contract without a specific termination date. The most common duration is 180 days (6 months). If the contract has an indefinite duration such as until sold, or no duration specified at all, don’t sign it. The listing contract is a legally binding document so don’t get locked into a contract that doesn’t clearly state a definite termination date. If the contract expires before the home is sold and the seller and Realtor wish to continue with the agreement, then an extension to the contract needs to be signed.

There can be and often are other elements to a listing contract. As with any legal document, it is important for the parties to be familiar with the terms and conditions. So it is advised that both seller and agent carefully read the contract in its entirety to be sure that they understand what they are signing. If there are any unclear questions about the listing contract, it would be wise to consult a lawyer for clarification.

Loan Modification Definition.
Loan modification is a process in which the lender works with the homeowner who is facing foreclosure or financial hardship and is having trouble making mortgage payment. The lender’s goal is to change the terms of the mortgage loan and make it affordable for the borrower.  The new terms for the loan will vary from lender to lender. Some of the changes could include: Temporary or permanent changes to the mortgage rate, term and monthly payments, the past due amount could be rolled into the loan, and the new balance re-amortized.
What to expect under President Obama’s  plan?
The main goal of the Loan Modification program under President Obama’s “Homeowner Affordability and Stability Plan” announced on February 18, 2009, is to reduce the monthly mortgage payments for homeowner struggling to make the payment.
  • The Lender has to bring down interest rates so the monthly payments don’t exceed 38% of the borrower’s income.
  • This initiative will match dollar-for-dollar any further reduction until the ratio comes down to 31%.
  • The principal will also be reduced, if necessary, to lower the monthly payments. The Treasury Department will share the costs.
  • Homeowner will be on a trial test with the new monthly payment for 3 months. If they make every payment on time the new rate and monthly payments will be fixed for five years.
Requirements for Eligibility
  • Your mortgage had to be originated before January 1, 2009
  • Owner-occupant (No investors)
  • Unpaid balance of $729,750 or less.
  • Be in financial hardship.
    • Due to increase in your mortgage
    • Income reduction
    • Suffer Hardship
    • Note: If you cannot afford the home due to job loss or a complete inability to pay, you will not qualify.
  • Monthly payments have to be 31% of your gross monthly income.

For many buyers, applying for the mortgage loan is one of the most stressful and confusing aspects of buying a home. The loan application process should not become a stressful time. By following a few easy steps, you’ll sail through the loan application process with no major problems. It is important to ask your Realtor for a list of his/her preferred lenders, which most likely will make the process less stressful. Establishing a good relationship with the professionals involved in the home buying process is the key to help every transaction to go smooth. it will also help the buyer to  achieve his/her desired goals.

Remember that everything is negotiable! Make sure you talk to at least 3 lenders and make them compete for your business…

So, get your notepad and take good notes. The following checklist will help you have a smooth loan application…

1. Make a list of any questions you have about the loan program.
Do not be afraid to ask questions. This is probably the most important transaction investment you will ever make. Be sure to understand the advantages and disadvantages of the various mortgage programs for which you may qualify. Some questions you may want to ask are:

  • What is a Loan Origination fee?
  • Can you lower your Origination fee?
  • What is a Discount Point?
  • What is a PMI? Is it a requirement?
  • What does it mean to “Lock the Rate”?
These are some examples of some important questions to ask. Make sure you request a “Good Faith Estimate Sheet”, and show it to your Realtor. He/she will make sure that you are not being charged too much or that there are no unnecessary fees.

Gather your paperwork.

In general, the documentation you will need includes:
Check for application fee and Appraisal

Property Information (if you already have a home in mind)
Purchase Agreement.
Copy of legal description and MLS sheet.
If you are selling your current home, copy of listing contract.
If you have sold your current home, copy of settlement statement (HUD-1).

Income & Assets

Pay stubs for the last 30 days.
For the past two years:

Names and addresses of each employer.

W-2s
Statements for each bank, mutual fund, and/or investment account for the last three months.
Estimated value of personal property and furniture.
If you have made any large deposits to your accounts:

Explanation and source for deposit.

If large deposit was a gift:

Signed gift letter (lender can supply).

Copy of gift check.

Copy of deposit receipt.
If you own more than 25% of a business:

Corporate or partnership tax returns.
If self-employed:

Tax returns for the last three years (with schedules).

Year-to-Date Profit and Loss Statement prepared by an accountant.
If you own rental property:

Tax returns for the last two years and current rental agreements.
If you are retired:

Pension Award Letter.
If you receive Social Security:

Social Security Award Letter.
If you are counting child support as income:

Copy of divorce settlement.

Copy of twelve months of cancelled child support checks.

Debts

Names, addresses, account numbers, balances and monthly payments on all current loans.
Explanation of credit report anomalies, including:

Late payments, credit inquiries in the last 90 days, charge-offs, collections, judgments and/or liens.

Bankruptcy filed within last seven years (bring a copy of your bankruptcy papers).

VA Loans

Copy of DD Form 214, Report of Separation.

Miscellaneous

Photo ID and proof of Social Security number.
Residence addresses for the past two years.
If applicable, a copy of your divorce decree.
If you are not a citizen, a copy of the front and back of your green card.

Unfortunately, due to economic crisis throughout the world some homeowners are faced with tough times and no money to fix their homes. Fortunately, Realtors understand the needs of homeowners. We know that some of them are  unable to keep up with their homes and stay current with their mortgage payments; therefore, we want to help them and help our community.
More than 600 Charlotte Realtors are getting together on April 24, 2009 with one big purpose of helping 32 homes in need of repairs throughout Mecklenburg and Iredell Counties. It is an initiative of the Charlotte Regional Realtor® Association (CRRA) Housing Opportunity Foundation (HOF).  This is not an easy project. Coordinating an event of this magnitude requires a lot of time and effort! CRRA and HOF are doing an unbelievable job coordinating this event.  We thank them for all their hard work!
My Team will consist of 29 Realors… We would be doing some roof repairs, yard work and possibly a tree removal…  This is the “before” of the event picture of the home site….
